Instances of temporary employment occur when a company is in need of short-time workers to maintain the efficiency of production and the continuity of employment, especially during holiday periods, when the number of permanent workers is insufficient, or if such a need arises as a result of worker’s illness. It may also refer to long-term occupation provided in the height of seasons and in other business situations encountered by our clients. In Poland it is still quite innovative but it is gradually earning its place on the domestic labour market. All issues related to employment of temporary workers are governed by the Act on temporary workers of 9 July 2003 (Journal of Laws of 2003 no. 166).
Hourly or monthly rates of pay for temporary workers are calculated by the User-Employer, according to the type of services performed. A temporary worker in the period of his/her employment with a company shall be granted equal rights, in terms of conditions of employment and remuneration, to those which are granted to the company’s permanent employees who perform substantially equivalent work. Remuneration for over-time work and shift-work shall increase by 50% and 100% respectively, pursuant to the Labour Code.
